Intellectual Property Image Claims
The Swamp Company frequently receives images from Customers, Vendors, and Associates that it uses for Social Media promotions, Advertisements, and on its website. All images used are vetted for authenticity and they are evaluated to confirm they do not infringe upon the Intellectual Property Rights of others. Should you believe imagery being used by The Swamp Company is Intellectual Property that you own, please complete the IP Dispute Form at the following link:Swamp Co. IP Claim. Our procedure for reviewing all IP Dispute Claims is (1) Review of Claim within 48 hours and determination if credible (2) If a case is deemed to be credible, the image will be temporarily removed for an additional 72 hours for further investigation and communication with claimant. (3) Images deemed to be compliant with our policy will be restored immediately, and images that are deemed non-compliant will remain removed and will be permanently purged from our Image Library.
Returns for Exchange or InStore Credit are permitted within 15 calendar days of package delivery or attempted delivery. Due to Christmas Season Gift Shopping, Returns are permitted within 45 calendar days from package delivery or attempted delivery for Orders placed between November 20th and December 20th. The Swamp Company will pay for return postage for any items determined to be defective, all defect claims must be made within 72 hours of package delivery. Returns for all other reasons may be permitted but all shipping will be the responsibility of the customer. All items returned must be in their original packaging and must not have had tags removed. All return shipments must have a valid RA Number which can be issued by contacting [email protected]. Items returned without an RA# will be not be accepted and will be returned to sender. Postage paid is not refundable. Please allow 7 to 10 days for proper processing of Returns and Exchanges.
Exchanges of merchandise are permitted within the Returns window stated above. Merchandise returned for any reason must be in its original packaging with tags still attached. For all Swimwear, the hygiene protection sheet must not have been removed in full or in part. For protection of our Customers, items from our Misbehavin’ category are not eligible for Return or Exchange. All returns of items to be exchanged must be assigned a Return Authorization number which will be issued by contacting [email protected]. The Swamp Company currently does not charge a restocking fee. Please allow 7 to 10 days for proper processing of Returns and Exchanges.
Clearance and Discontinued item sales are final and are not eligible for Return or Exchange.
Damage & Breakage Claims
All claims for breakage and/or shipping damage must be made within 72 hours of package delivery or attempted delivery – no exceptions.
Due to cutoff times established by our carriers, Orders received after 9AM EST are applied to the following business day. Federal holidays and Sundays are not counted as operating days with regards to the delivery window selected by the Customer at Checkout. The Swamp Company is not responsible for delivery delays associated with weather events and/or natural disasters. The Swamp Company uses the United States Postal Service as its primary shipping carrier but may use other freight companies at it’s discretion. A variety of shipping options are available for selection during the Checkout process, details on those options are as follows:
FREE Shipping: Applies to the contiguous 48 United States and is not subject to order size. Orders with FREE Shipping selection have an expected delivery time of 10 to 12 days. Delivery time for this option is estimated, and is not guaranteed.
ECONOMY 5 to 10 Day Shipping: Applies to the contiguous 48 United States and is not subject to order size. Orders with ECONOMY Shipping have a guaranteed delivery of 5 to 10 days.
EXPEDITE 3 to 5 Day Delivery: Applies to the contiguous 48 United States and is not subject to order size. Orders with Expedite 3 to 5 Day Delivery selection have a guaranteed delivery of 3 to 5 days.

NON-BEDDING FLAT RATE Canada Shipping: Current rate is $9.99 and applies to all of Canada and is not subject to maximum or minimum order dollar value. The average transit time for Canada packages is 14 days but may take as long as 2 to 4 weeks subject to Customs delays that are beyond our control. The Swamp Company does not collect, and has no involvement in taxes, tariffs, or duty for international shipments.
BEDDING BULKY ITEM FLAT RATE CANADA SHIPPING: Current rate is $29.99 and applies to all of Canada and is not subject to maximum or minimum order dollar value. INTERNATIONAL FLAT RATE (Non-Canada) SHIPPING: Current rate is $39.99 and applies to all countries outside of the United States and Canada. Please allow 30 to 45 days for the delivery of International packages. The Swamp Company does not collect, and has no involvement in taxes, tariffs, or duty for international shipments.
Undeliverable Packages: To provide affordable shipping rates to it’s customers, The Swamp Company heavily subsidizes all shipping speed fees. As an example, a Customer choosing Economy Shipping for an Order may only be charged $1.99 for Shipping, while the actual postage may be $5. In such a case The Swamp Company pays for any postage deficits as a subsidy for the Customer. This subsidization occurs once, and once only, with the original Order Shipment. Packages returned to The Swamp Company due to incorrect addressing provided by the Customer will be reshipped at the full and unsubsidized shipping rate, and must be paid for by the Customer prior to shipping. Packages returned to our warehouses due to improper address information provided by the Customer may also be subject to a $10 reprocessing fee.
DELIVERY GUARANTEES: Guaranteed ship speeds is reliable 99.2% of the time. The Swamp Company is not responsible for delivery delays caused by weather as noted by all carriers.
Refunds are only given as In-Store Credit. In-Store Credit is only issued for items returned with a Swamp Company RA Number (Return Authorization). All goods returned for any reason must be in compliance with all Return/Exchange Policies of The Swamp Company. Assignments of In-Store Credit are issued in the order they are received and may take up to 10 Days for processing. In-Store Credit Assignments expire after one calendar year from the date of issue.
Customer Communications and Code of Conduct
The Swamp Company communicates with it’s customers in multiple ways including, but not limited to Email, Web Site Chats, Facebook Messenger, and Telephone. The Swamp Company pledges to deal with customers promptly, and in a courteous, professional, reasonable, and respectful manner; the same is in turn expected of the Customer. Communications from customers directed to our staff, affiliates, or other patrons containing threats, clearly unrealistic demands, obvious alleged untruths, personal insults, vulgarity, or deemed harassing in nature will be reviewed by our Directors. Reviewed communications found to be in violation of our Code of Conduct Policy may result in Order Cancellation, Banning from Social Media following, Blocking of known IP Addresses, and if applicable, notification to appropriate legal authorities. The Swamp Company’s exceptional reputation has been earned by years of hard work and it will be defended to the fullest extent the law will allow.
